Swimming Pool Zoning Laws and Fencing Requirements Township of Cranford, Union County

374-1Definitions.

As used in this chapter, the following terms shall have the meanings indicated:

PRIVATE SWIMMING POOL

Includes artificially constructed swimming pools or tanks established or maintained upon any premises by any individual for his own or his family’s use or for use by guests of his household.

WADING POOL

Includes artificially constructed pools not designed or used for swimming, with a maximum area of 120 square feet and a maximum water depth of 18 inches.

374-2Permit required; exception.

No person shall establish, erect, assemble or construct a private swimming pool without first having obtained a permit therefor from the Construction Official. The permit fee shall be as prescribed in § 186-2 of this Code. No permit shall be required for a wading pool.

374-3Location of pools.

No private swimming pool or wading pool shall be constructed or installed on any lot unless there is located upon said lot a residence building as permitted in residence zones as provided by Chapter 255, Land Development, Article V, Zoning, of this Code.

374-4Standards.

Private swimming pools shall comply with the International Building Code 2015, New Jersey Edition, Section 3109, Swimming Pools, Spas and Hot Tubs, as adopted under N.J.A.C. 5:23-3.14.

374-5Violations and penalties.

Any person who violates any provision of this chapter shall, upon conviction thereof, be punished as provided in Chapter 1, Article I, of this Code.
