A swimming pool that is operated for profit and open to the public or to a limited number of members and their guests, upon payment of an hourly, daily, weekly, monthly, annual or other fee, or operated as a service rendered by a hotel, motel, or apartment development whose units are rented to transient or permanent residents and having appropriate dressing room facilities, recreational facilities and off-street parking areas.
A swimming pool located on a single-family lot with a residence on it and used as an accessory to the residence, and said pool is utilized with no admission charges and not for the purpose of profit.
Has the same meaning as “swimming pool, commercial.”
All types of private swimming pools to be located within residential side or rear yards are governed by the requirements contained herein, including:
Permanent in-ground.
Permanent aboveground: aboveground pools equipped with fences built above the top level of the pool.
Temporary aboveground: aboveground pools not equipped with fences built above the top level of the pool.
All lighting fixtures for a private swimming pool shall be installed so as to comply with all applicable safety regulations, and shall be shielded so as to prevent any direct beam of light from shining on any adjoining property.
No overhead electric lines shall be carried across any swimming pool or wading area.
No activities shall be conducted at any private swimming pool which shall cause undue noise or constitute a nuisance to any neighbor.
Application requirements.
When an application is made for a permit to construct and locate a private swimming pool, the applicant shall show an approval from the Board of Health as to the suitability and adequacy of design, materials, and construction or construction specifications of said pool, including all accessory equipment, apparatus, and appurtenances thereto.
The application for a private swimming pool building permit shall identify the building pool, all accessory equipment and apparatus, type of pool, all basic dimensions, location of steps, diving stands, boards, and location and detail specification of enclosure and gate on the lot.
An outdoor private swimming pool shall be located not less than eight feet from the side or rear of the residence on a building lot, to the rear of the building setback line.
The pump of a filtration or pumping station of a private swimming pool shall be located not less than 10 feet from any side or rear property line.
Private pools situated in or extended above ground level and less than 50 feet from an abutting property shall be surrounded by a suitable drainage system leading to a street or brook so as to be able to carry away all the water in the pool in the case of a break.

The International Residential Code 2000, New Jersey Edition, Appendix G, included with this chapter shall apply.[1]

As used in this chapter, the following terms shall have the meanings indicated:
A secure barrier or obstruction of not less than four feet in height, so constructed as to entirely enclose the particular swimming pool itself or the yard in which it is located or the entire property, and which shall bar all reasonable and normal access to the area except through a substantial self-closing and self-latching gate or gates of the same height as the fence, equipped with facilities for locking said gate or gates when the pool is unattended or unguarded.

Any individual, firm or corporation having an interest in the lot or lots on which a swimming or portable pool is located, as owner, tenant, occupant, or the agent, servant or employee of such owner, tenant or occupant.
Any above-surface-type pool, not stationary or fixed and capable of being removed for storage.
Fill-and-draw, flow-through and recirculation pools, located outdoors, which are artificially constructed to provide recreational facilities for swimming, bathing or wading, and all equipment and appurtenances thereto.
No person shall construct, maintain or use, or cause, suffer or permit to be constructed, maintained or used, any swimming pool or portable pool on any lot or lots in the City of Northfield unless there shall be constructed and maintained a fence enclosing the area on which said swimming pool or portable pool is located.

Sections 338-2 shall not apply to portable pools less than 24 inches deep or having a surface area of less than 250 square feet.
338-4Applicability to existing pools.
The provisions of this chapter shall apply to swimming pools and portable pools now existing and to swimming pools and portable pools hereafter constructed; provided, however, that as to swimming pools and portable pools now existing and not enclosed by a fence, there is hereby established a period of 60 days from the effective date hereof within which to construct such fence.
338-5Closing and locking of gates.
The gate or gates in the fence shall be kept closed at all times, except when being used for ingress or egress, and shall be kept locked at all times when the swimming pool or portable pool is unattended or unguarded.
338-6Additional regulations. [1]
Nothing herein shall be deemed to alter, modify or repeal any additional requirements concerning the construction, maintenance or use of swimming pools or portable pools as provided in Chapter 215, Land Use and Development, the Building Code or any health regulations of the City of Northfield.

338-7Violations and penalties.

The penalty for violation of any provision of this chapter shall be as set forth in Chapter 1, General Provisions, § 1-15.
