137-1Adoption of standards by reference.
A code regulating the construction and alteration of swimming pools, wading pools and appurtenances thereto, including general layout and design, recirculation systems, filtration systems, disinfection, wastewater disposal, dressing rooms and bathhouses, showers, toilets and lavatories, emergency equipment, bathing water quality, supervision and maintenance, and declaring violations of said code a nuisance and prescribing penalties therefor, is hereby established pursuant to P.L. 1950, c. 188 (N.J.S.A. 26:3-69.1 to 3-69.6). A copy of said code is annexed hereto and made a part hereof without the inclusion of the text thereof herein.
The said code established and adopted by this chapter is described and commonly known as the “Swimming Pool Code of New Jersey — 1970.”
Three copies of the said Swimming Pool Code of New Jersey – 1970 have been placed on file in the office of the Health Officer of this Board of Health upon the introduction of this chapter and will remain on file there for use and examination by the public.
137-4Amendments, additions and deletions.
The code herein established and adopted is hereby supplemented by adding the following section:
Section 2.7.1 Fee – A fee for licensure of swimming pools, as required herein, in the amount of $25, shall be paid by the applicant upon the issuance of such license. Said licenses shall be obtained annually before any swimming pools governed by this chapter are occupied. Said licenses shall terminate at 12:00 midnight on December 31 of each calendar year.
137-5Violations and penalties.
Any person who violates or neglects to comply with any provision of this chapter or code established herein or notice issued pursuant thereto shall, upon conviction thereof, be liable to a penalty of not less than $5 nor more than $500 for each violation.
137-6Repealer; conflicts with Uniform Construction Code.
All ordinances, codes or parts of the same inconsistent with any of the provisions of this chapter and the code established hereunder are hereby repealed to the extent of such inconsistency, except for the New Jersey State Uniform Construction Code. The regulations of the New Jersey State Uniform Construction Code shall control in the event of a conflict between its provisions and that of the Swimming Pool Code of New Jersey – 1970, and the provisions of said Swimming Pool Code are hereby repealed to the extent of any such inconsistency with the New Jersey State Uniform Construction Code.[1]
