299-1Swimming pools.

Code established. A code regulating and controlling the location and construction, alteration and operation of swimming pools, and the issuance of permits to locate and construct, alter or operate swimming pools, and declaring and defining certain swimming pools as nuisances and fixing penalties for violation is hereby adopted pursuant to N.J.S.A. 26:3-69.1 et seq. A copy of the code is annexed to this chapter and made a part of it without inclusion of the text.

Title of code. The code established and adopted by this chapter is described and commonly known as the “Swimming Pool Code of New Jersey (1970).”

Copies of code on file. Three copies of the Swimming Pool Code of New Jersey (1970) have been placed on file in the offices of the Secretary of the Board of Health and the Borough Clerk for the use and examination of the public.

299-2Lake bathing places.

Adoption by reference. The Board of Health of the Borough of Old Tappan hereby adopts by reference the provisions of the Lake Bathing Place Bacteriological, Sanitary and Safety Guides prepared by the New Jersey State Department of Health, by reference, a copy of such guide being attached hereto and made a part hereof.

Public record. Three copies of such guide have been placed and shall remain on file in the office of the Board of Health for the use and examination of the public.

255-51Private swimming pools.

Private swimming pools, as defined by the provisions of the Uniform Construction Code of New Jersey, N.J.A.C. 5:23-11 et seq., shall be permitted as an accessory use in a residential district. Such pools and pertinent decks, walkways or other structures shall be located as follows:

Such pools and appurtenances shall be located in back of the rear building line of the existing or proposed dwelling.

On all interior lots, all such pools and appurtenances shall be located a minimum of 10 feet from any rear or side property line in any residential district.

On any corner lot, all such pools and appurtenances shall be located a minimum of 30 feet from the street side property line in an RA 40 District and a minimum of 20 feet from the street side property line on all other residential districts.

255-77Fences for private swimming pools.

Fences erected in connection with private swimming pools in residential zones shall separately comply with all the applicable requirements of the Uniform Construction Code.
