267-1License for pools.

In accordance with N.J.A.C. 8:26-2.8, a recreational bathing place shall not be open for public use until the Health Department of the City of Passaic has given formal approval by the issuance of a license. This license shall be displayed in a conspicuous place on the premises where it may be readily observed by all patrons. No person shall operate a recreational bathing place whose license has been suspended.

267-2Pool requirements.

All of the provisions set forth in N.J.A.C. Chapter IX entitled “Public Recreational Bathing” set forth in N.J.A.C. 8:26-1 et seq. are hereby incorporated by reference, and copies of that code section shall be placed on file with the office of the City Clerk as well as the Health Department for use and examination by the public.

267-3License fees; filing.

Fees.

(1) 

The license fee for a seasonal summer pool shall be $125.

(2) 

The license fee for a year round pool shall be $250.

(3) 

Tax exempt or nonprofit entities that have swimming pools shall not be required to pay the license fee but must comply with all other requirements of this chapter.

(4) 

Duplicate license fee shall be $25.

The applicant for a license for a pool open to the public shall file the application as established by the Health Department with all the information required in addition to the license fee to the Health Department Office in the City of Passaic.

267-4Exempt pools.

Licenses shall not be required for private bathing places. A “private bathing place” means a body of water, natural or modified by man, used for swimming, diving and recreational bathing by an individual, family or living unit member(s) and their guests which shall not serve any type of cooperative or condominium building or joint tenancy of three or more living units.
