PRIVATE SWIMMING POOL

Any artificially constructed basin or other structure for the holding of water for use by the possessor, his family or guests for swimming, diving and other aquatic sports and recreation. The term “swimming pool” does not include any plastic, canvas or rubber pool temporarily erected upon the ground and holding less than 500 gallons of water.

277-1Standards.

Chapter 9 of the State Sanitary Code, Public Recreational Bathing (N.J.A.C. 8:26), is hereby established as the standard for public swimming facilities in the Township of Byram.

277-2License required.

No person shall locate and construct, alter or operate a swimming pool until licenses therefor have been issued by the Board of Health. For purposes of this chapter, “swimming pool” shall not include naturally or artificially constructed outdoor ponds, rivers or lakes, nor baths used for cleansing of the body or practice of the healing arts. It shall not include swimming pools or wading pools established or maintained upon any premises by an individual for his own or his family’s use or guests of his household.

277-3Fees and charges.

The following fees and charges are herewith established:

For the issuance of a license to locate and construct, alter or operate a swimming pool: $50.

For the renewal of a license to operate the swimming pool: $50.

277-4Expiration and renewal of licenses.

Licenses issued for the operation of a swimming pool shall expire annually on December 31, and application for renewal thereof shall be submitted, together with the required fee, prior to December 1 of each year.

277-5Denial or suspension of licenses.

Licenses required by this chapter may be denied or suspended by the Board of Health for failure to comply with this chapter and the code incorporated herein.
