331-1Standards in force.

Standards regulating and controlling swimming pools and all recreational bathing facilities, including hot tubs and spas, except private bathing places as defined in N.J.A.C. 8:26-1.3, being Chapter IX, of the State Sanitary Code, Public Recreational Bathing, are in force and effect in the Township of Hanover.

PRIVATE SWIMMING POOL

Any artificially constructed basin or other structure for the holding of water for use by the possessor, his family or guests for swimming, diving and other aquatic sports and recreation. The term “swimming pool” does not include any plastic, canvas or rubber pool holding less than 500 gallons of water temporarily erected upon the ground.

Copies of said New Jersey State Sanitary Code, Chapter IX, Public Recreational Bathing [N.J.A.C. 8:26-1 et seq. (1987)], have been placed on file in the office of the Secretary of this Board of Health and will remain on file in said office for the use and examination of the public.

331-3Permits or licenses required.

No person shall locate and construct, alter or operate a swimming pool, hot tub or spa until permits or licenses therefor shall have been issued by this Board of Health.

331-4Fees and charges.

The following fees and charges shall be as provided in Chapter 284, Fees, of the Code of the Township of Hanover.

Swimming pools:

(1) 

For the issuance of a permit to locate and construct a swimming pool.

(2) 

For the issuance of a permit to alter a swimming pool.

(3) 

For the issuance or renewal of a license to operate a swimming pool.

Hot tubs and spas.

(1) 

For the issuance of a permit to locate and construct a hot tub or spa.

(2) 

For the issuance of a permit to alter a hot tub or spa.

(3) 

For the issuance or renewal of a license to operate a hot tub or spa.

331-5Expiration of licenses.

Licenses issued shall expire annually on March 31 of each year, and application for the renewal thereof shall be submitted, together with the required fee, prior to March 1 of each year.

331-6Denial or suspension of permits and licenses; hearing.

Permits or licenses required by this chapter or code may be denied or suspended by this Board of Health for failure to comply with this chapter or code.

This Board of Health shall afford the person whose permit or license to locate and construct, alter or operate has been denied or suspended an opportunity to be heard in public hearing and, following this, to be informed of the Board’s decision.

331-7Violations and penalties.

Any person or persons, firm or corporation violating any of the provisions of this chapter or the New Jersey State Sanitary Code, Chapter IX, Public Recreational Bathing, shall, upon conviction thereof, pay a penalty of not less than $2 nor more than $500 for each violation.

Each day that a particular violation continues shall constitute a separate offense.
