Facilities constructed above or below ground having a depth of more than two feet or a water surface of 100 square feet or more and designed and maintained for swimming purposes. “Swimming pools” shall include all buildings, structures, equipment, aprons and appurtenances, all of which shall be considered part of the total improvement constructed on the site.

Editor’s Note: The preamble to this ordinance provided for a definition of “private swimming pool” as a pool generally used for recreational purposes and is either in-ground or on the surface, located on private property, whose operation is the responsibility of the owner.
No person shall provide, maintain, or keep a pool in any manner on any property unless it is maintained pursuant to this article.
The provisions and prohibitions hereinafter contained and enacted are in pursuance of and for the purpose of securing and promoting the public health and general welfare of persons in Westampton Township and to prevent the spread of diseases from mosquito transmission by preventing the presence of mosquito larvae in pool water that is not maintained properly.
258-8Pool maintenance standards.
Pool maintenance standards shall be as follows:
Maintain the pool with an adequate disinfecting agent that imparts sufficient residual which provides for easily measured continual disinfections; provide daily circulation of the pool water with a properly functioning circulation system; and daily removal of any debris.
When in use, the pool water shall be sufficiently clear to permit clear visibility of the bottom of the pool.
When the owner is away and cannot maintain the pool, a biological pesticide shall be used in the pool (e.g., Bti Briquettes, mosquito Dunks)
Empty tot pools when not in use and refill daily.
Any pool cover must be maintained in a way to prevent the collection of stagnant rainwater.
258-10Enforcement; violations and penalties.
Minimum penalty. There shall be a minimum penalty of a fine fixed at an amount not less than $50, first offense, $100, second offense, $150 third and subsequent offenses.
Separate violations. Each and every day in which a violation of any provisions of this article exists shall constitute a separate violation.
It shall be the responsibility of the Municipal Code Enforcement Officer and/or Burlington County Health Department to enforce this article.
